4. Regulation 17 and 18 - Examination and Examiners Report (January – February 2023)

Following the formal Regulation 16 – Public Consultation draft Harden Neighbourhood Development Plan, which took place between 20 June and 15 August 2022, the plan was submitted for independent examination

Andrew Freeman BSc (Hons) DipTP DipEM FRTPI of Intelligent Plans and Examinations (IPE) Ltd was appointed to undertake the independent examination.

The examination considered whether the plan meets the basic conditions and other requirements set out in law, in particular whether it:

  • has regard to national policy
  • contributes to the achievement of sustainable development
  • is in general conformity with the adopted strategic policies for the local area
  • is compatible with EU obligations
  • meets human rights requirements.

The Examiner issued a letter to the Council and Harden Village Council outlining a number of Procedural Matters regarding the management of the Examination. This also included a number of questions where additional information was required from Bradford Council and the Village Council in order to provide further clarification on specific issues. Details of these are provided below.

Examiner's Report

Following the examination of the Harden Neighbourhood Development Plan, it was recommended that, subject to a number of modifications, the plan should move forward to referendum in the neighbourhood area (the Parish area of Harden).

The Examiner's Report and recommendations were received on 22 February 2023.

The report will be considered by the Council's Executive in due course.
